Please read these Terms and Conditions ("Terms") carefully before using the Ayva mobile application ("the App") operated by Ayva ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using Ayva, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Ayva is an AI-powered personal assistant application for Android devices. The App provides:

• AI-powered conversational assistance
• Integration with third-party services (Spotify, Google Calendar, Gmail, etc.)
• Proactive notifications and reminders
• Voice input capabilities
• Music control and personalization

3. Account Registration

To use Ayva, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscriptions and Payments

Free Tier

Ayva offers a free tier with limited features. Free users have access to basic AI chat capabilities with a daily message limit.

Premium Subscription

Premium features are available through a paid subscription processed via Stripe. Subscription details, pricing, and billing cycles are displayed within the App before purchase.

Cancellation

You may cancel your subscription at any time through the App settings. Upon cancellation, you will retain premium access until the end of your current billing period.

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or hack the App
• Abuse the AI system with harmful, abusive, or spam content
• Share your account credentials with others
• Exceed rate limits or abuse the API
• Use the App to generate content that violates third-party rights

6. Third-Party Integrations

Ayva integrates with third-party services including Spotify, Google (Calendar, Gmail, Maps, Contacts), and Stripe. Your use of these integrations is subject to the respective terms of service of each provider. We are not responsible for the availability or functionality of third-party services.

7. AI-Generated Content

Ayva uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You should not rely on Ayva's responses as professional advice (medical, legal, financial, etc.).

8. Intellectual Property

The App, including its code, design, and content, is the intellectual property of its developers. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or service interruptions.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, abuse the service, or engage in activities that could harm other users or the platform.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes via the App or email.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.
